Results of the NCCIR meeting dated 07 November 2017

According to the NCCIR decision, “The Register of Telecommunications Operators and Providers” was supplemented with 25 positions. The Commission issued five licenses for operating in telecommunications sector and re-issued 11 licenses for the use of radio frequency resource of Ukraine. These and the other decisions were adopted during the regular NCCIR meeting on November 07, 2017.

According to the Commission’s decision, six operators and nineteen providers were added to “The Register of Telecommunications Operators and Providers” on the basis of market participants’ applications.

Moreover, eighteen economic entities have informed the Commission of change in the contact details, the type of activity or the territory of activity to make relevant information in “The Register of Telecommunications Operators and Providers”.

In accordance with paragraph 4.1 of the Order for maintaining the register of telecommunications operators and providers, in connection with the termination of activities in the telecommunications sector, which is confirmed by the information from the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Formations, 37 economic entities were excluded from “The Register of Telecommunications Operators and Providers”.

NCCIR has adopted the decision to issue two licenses (according to the relevant applications) for operating in telecommunications sector:

  • LLC “Tsentr nadannia media posluh” – a license for the provision of fixed local telephony with the capacity on to 1.000 subscriber numbers with the right of engineering maintenance and telecom networks operation, providing telecommunication channels in the territory of Poltava and Kirovohrad Oblast for a term of 5 years;
  • LLC “Kompaniia “Konfidentsiini telekomunikatsii Ukrainy” – a license for the provision of fixed local telephony with the capacity of more than 10.000 subscriber numbers with the right of engineering maintenance and telecom networks operation, providing telecommunication channels in the territory of Kyiv city for a term of 5 years.

Due to decrease in the number of regions, NCCIR has re-issued two licenses for LLC “lifecell” for digital cellular radio communication of GSM-900 standard in 25 regions of Ukraine.

Moreover, the Commission has extended the validity of three licenses for the use of radio frequency resource of Ukraine for:

  • LLC “LAHIDKOM” – a license for the use of radio frequency resource for broadband radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information) from February 27, 2018 till February 26, 2023 in the territory of Rivne Oblast;
  • PJSC “Kyivstar” – a license for the use of radio frequency resource for digital cellular radio communication of GSM-900 from February 27, 2018 till February 26, 2023 in 8 Oblast of Ukraine, and also for the use of radio frequency resource for radio link communication (radio link communication of fixed radio service) from February 27, 2018 till February 26, 2033 in 6 Oblast of Ukraine.

In connection with the earlier adopted decision on the issuance of a license for a RF bandwidth that is declared, PJSC “Poltavskyi hirnycho-zbahachuvalnyi kombinat” was refused in obtaining a license for the use of radio frequency resource of Ukraine for broadband radio access (a radio data transmission system using noise-shaped signal) within Poltava Oblast.

In connection with the earlier adopted decision on the issuance of a license for a RF bandwidth that is declared, and appeal of NCCIR decision dated 10 January 2017 No. 10 by LLC “SFERAMAKS”, PJSC “Tsyfrovi Komunikatsii” was refused in obtaining a license for an additional RF bandwidth for broadband radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information) within Kirovohrad, Kherson and Mykolaiv Oblast.

According the statement of licensee – LLC “VINETIKA”, the license for the use of radio frequency resource of Ukraine for broadband radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information) in the territory of Chernihiv Oblast was revoked.

In accordance with Articles 34, 38 of the Law of Ukraine “On Radio Frequency Resource of Ukraine” and Paragraph 10 of the Procedure for attracting of additional extrabudgetary funds for the conversion of the radio frequency resource of Ukraine in common bands, approved by the Order of the Cabinet of Ministers of Ukraine, dated August 01, 2007 No. 993, and in connection with the receipt of applications from LLC “MMDS-Ukraina” concerning the re-issuance and revocation of licenses for the use of radio frequency resource of Ukraine because of the RF bandwidth decrease, the Commission has adopted the decision to re-issue 10 licenses for LLC “MMDS-Ukraina” for multiservice radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information) in 26 regions of Ukraine. Additionally, according to LLC “MMDS-Ukraina” application, the license for the use of radio frequency resource of Ukraine for multiservice radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information) in the territory of Chernivtsi Oblast was revoked. This decision is put into effect from the day of its publication at NCCIR website, but not earlier than the day of the conversion contract(s) execution, which is (are) confirmed by the acts of the conversion contract execution, signed by the initiators and the subject of the conversion (LLC “MMDS-Ukraina”).

According to the Commission’s decision, 49 new types of facilities were added to “The Register of REFs* and RC**”.

The information about 8 types of radio facilities was changed in “The Register of REFs and RC”.
